In recent years, China has been carrying out policy reserve constantly, and big data has become one of national strategies. As one of the five pilot cities of opening up public information resources, Shanghai has taken the lead in establishing data opening portals in China since 2012. Up to now, more than 2100 data resources have been opened to the public, covering the main business areas of municipal government departments. The wider and more valuable open of public data needs more perfect legal system and various mechanisms.
On the afternoon of February 5th, the deputies of the Shanghai League to the National People's Congress discussed and put forward proposals. Chen Mingbo, Deputy to the National People's Congress and Deputy Secretary-General of Shanghai Municipal Government, made proposals on the amendment of network security law.
Mr. Chen said it is found that there is a certain gap between data opening work of Shanghai and that of international advanced level in terms of data opening quality, depth, data utilization and legal system construction. Especially some high-value public data, which are closely related to people's livelihood, urgently needed by society and with significant value-added potential in the industry, have entered a bottleneck period of opening up and application due to the lack of clear guidance from the superior laws and regulations. Many other provinces and municipalities are facing the same problem.
Mr. Chen proposed to amend the general provisions of Chapter I of the "National Network Security Law" and to increase the general principles of the State's support for open circulation of public data. The “National Network Security Law” should be amended and added separate chapters to provide for the support and promotion of open circulation of public data. It is necessary to amend Chapter IV of the law to increase the content of public data security. What's more, it is also advisable to amend Chapter VI to increase the content of legal liability for the use of public data.
Shanghai is making great efforts to study the local laws and regulations on management of public data opening. Now the city has started the legislative work in an all-round way, aiming at taking the demand as the orientation, adopting the hierarchical and classified management mode, strengthening the data security protection, promoting the application of public data fusion, and doing a good job of local practice for the relevant national laws and regulations.
