Shanghai promulgated the first interim measures in China for the management of opening public data

      On the afternoon of September 25th, the Information Office of Shanghai Municipal Government held a press conference. Chen Mingbo, Deputy Secretary-General of Municipal Government, introduced "the Interim Measures for the Opening of Public Data in Shanghai". Relevant leaders were present and answered the questions from the journalists, including Wu Jincheng, Chairman of Shanghai Municipal Commission of Economy and Informatization, Zhu Zongyao, Director of Municipal Big Data Center, and Luo Peixin, Deputy Director of Municipal Judicial Bureau. 

      

     

      Opening public data is an important driving force to promote the development of digital economy and guarantee the livelihood of the people. It is also an inherent requirement to promote the openness of government affairs, enhance the concept of government management and realize the modernization of government governance ability. Shanghai Municipal Committee and Municipal Government attach great importance to the development and utilization of public data. Since 2012, they have taken the lead in exploring the opening of public data in China. From 2017 to 2019, Shanghai ranked first in the third-party evaluation of China's local government data openness for three consecutive years. Recently, the Interim Measures for the Opening of Public Data in Shanghai (hereinafter referred to as the "Measures") have been deliberated and approved by the Executive Meeting of the Municipal Government and will be formally implemented on October 1 this year.

Overall considerations

      As the first local government regulation aiming at the opening of public data in China, the Measures will guide the development and utilization of public data in this city into a new stage. Four kinds of relationships are taken into account.

      First, clarify the relationship between service and management responsibility. Public data should provide effective data resources for the market and society, and serve the people's needs for a better life through development and utilization. At the same time, public administration departments should establish complete data open standards and norms and clarify the relevant management authority and obligations.

      Second, the relationship between data openness and data security should not only promote utilization of public data, but also guarantee data security and legal compliance. It is an important consideration in this legislative work to formulate strict data security protection measures throughout the process.

      Third, the relationship between the principle of international access and the actual situation in Shanghai. On the basis of referring to the principle of "integrity, limitation, primitiveness" and other international access principles, the legitimate rights and interests of third parties, such as personal privacy and trade secrets, are fully protected, and various open modes are provided for different users.

      And fourth, the relationship between open platform and Multi-Cooperative ecology must follow the unified standards to open public data in a unified portal. At the same time, it is important to encourage the market to conduct data governance, provide data services, standardize data utilization, and jointly build a healthy and inclusive ecosystem.

Main Contents of the Measures

      There are 8 chapters and 48 articles in the Measures, which clarify the general principles, open mechanism, platform construction, data utilization, multiple openness, supervision and protection, and legal responsibilities.

      The development and utilization of public data is a forward-looking and systematic work, which needs to be optimized and innovated in continuous practice. At present, according to the needs of the society, four area shave been identified as the focus of this year's opening up, including Inclusive Finance, Transportation, Healthcare and Cultural Tourism. Especially in inclusive finance, Shanghai has carried out eight departments and four pilot banks with authorized, helping to solve the financing difficulties and problems of small and micro enterprises, and striving to achieve tangible results by the end of this year. For the next step, Shanghai will speed up the implementation of the Measures, strengthen organizational coordination, supervise the implementation mechanism, and advance all work in a safe and orderly manner. In practice, it is important to constantly improve the Measures, speed up the improvement of the government's ability of public governance, and inject new impetus into the high-quality development of economy and society.
